法治日报：“困”在私域直播间的老年人们 \u003cdiv class=\"rich_media_content\"\u003e\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e“戴上对健康有好处，而且也退不了货了。他们的老板被关在国外了，家里人只能通过卖手镯来凑赎金。”面对儿子对其花高价购买的“养生金手镯”“戴上无用、赶紧退货”的指责，来自浙江的李伟的母亲语气坚定地重复着私域直播间里主播的说辞。\u003c/p\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e李伟近来颇为苦恼。他的母亲沉迷于私域直播购物。这类直播近年来在中老年群体中悄然兴起。李伟介绍，母亲把加入的十多个购物群都置顶了，直播时间排得密密麻麻：“早上6点一场，9点一场，下午2点一场，晚上7点一场，每场差不多播两小时。”\u003c/p\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e最初，他的母亲是通过“线下免费送鸡蛋”等活动接触到这些商家，随后被拉入社交群。直播内容起先以养生讲课为主，并不直接卖货，还会通过提问发红包等方式吸引他们参与，但随后逐渐转为私域直播带货，售卖羊奶粉、驼奶粉等保健品……\u003c/p\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e“不好用，不便宜。”李伟说，“我查询后发现，他们卖的很多种保健品，实际上是含少量维C的糖果。”李伟的母亲本身就患有\u003c!--SECURE_LINK_BEGIN_0--\u003e糖尿病\u003c!--SECURE_LINK_END_0--\u003e，这让他更为担忧。\u003c/p\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e李伟发现，自去年9月起，母亲每月仅在私域直播购物上就要花费两三千元，还不包括听完直播后去线下购买的各种保健品，这些几乎耗尽了母亲每月的养老金。仅仅一年时间，家中就堆满了大量此类商品，“因为不想总被家里人说，有不少还被她藏在房间和车库”。\u003c!--MID_AD_0--\u003e\u003c!--EOP_0--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_0--\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e“交易方式太隐蔽。”李伟说，自己根本无法查看母亲具体买了什么，“只能在交易记录里看到一笔笔付款，下单后都统一到领鸡蛋的门店拿货。”不仅如此，他甚至连群聊都无法进入，“都是线下的群成员拉父母进去的，其余人进去会被‘踢’，群里的链接也是直播结束后就失效”。\u003c!--MID_AD_1--\u003e\u003c!--EOP_1--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_1--\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e李伟曾多次劝说母亲不要再买这些商品，但母亲坚称“吃了后就没再感冒生病”。如果再劝，其便会说子女不考虑自己，“她也想身体好少给子女增添负担”。\u003c/p\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e店里工作人员在上课时，还会经常给老年人洗脑。李伟透露，店家会说，子女不让买东西是惦记父母的钱，让他们自己想开点，好好养生，自己喜欢什么就买什么。“真的很影响家庭和睦，一劝就说‘子女不孝顺’。”\u003c/p\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e李伟并未停止过“斗争”。他曾尝试向当地市场监管部门举报，但收效甚微，商家在私域直播间照常经营。如今，李伟发现商家套路再次升级：“此前私域直播间售卖的产品在电商平台上搜不到，现在会出现高价同类链接，并谎称‘全国几千家连锁店都有销售’，实际上，我发现大多数店铺都是新开的，销量多为零。”\u003c!--MID_AD_2--\u003e\u003c!--EOP_2--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_2--\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e来自山东的林涛也有类似的经历。据他所说，家中的老年人已在这类直播间里买过“上千元的‘包治百病’的椅子、大几千元的‘电磁波’帽子”。而无论子女如何劝说，老年人仍然不为所动，“老太太只会哭天抹泪，认为我舍不得给她花钱，觉得我不孝顺”。\u003c/p\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e偷偷查看母亲手机后，林涛发现这些群聊里全都是五六十岁到七八十岁的老年人。他介绍道，这类群聊给老年人们打造了一个“安全屋”：加一元成为会员即可入群，每天定时发链接看直播，不定时三两角红包，“老年人看得不亦乐乎”。\u003c/p\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e“老年人的交际圈比较固定，也比较相信朋友的话，一旦‘攻下’一位老年人，很可能就能顺势‘拿下’一批老年人。”林涛说，比如自己的母亲，现在周围都是陪着一起“上当”的老年人。\u003c/p\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e在商家的鼓动下，老年人也会在自己的社交圈里宣传推广。来自河南的罗芳告诉记者，她的一位亲戚最近正在极力劝说她的父亲加入此类私域直播的社交群。\u003c/p\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e“最开始，这个亲戚的配偶买了一本健康书，书上附有二维码，旁边写着可以扫码免费听课，他这才接触到私域直播。后来，他就拉着我父母，还有关系好的同事一起听这个课。拉人是有奖励的，但是具体什么奖励亲戚没说。”罗芳对记者说，其实所谓的课程，就是每天边看直播边答题，问一些健康相关的知识，给消费者营造天天看直播就能增加健康知识的错觉，至于这些知识的对错无从考证。\u003c!--MID_AD_3--\u003e\u003c!--EOP_3--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_3--\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e目前，罗芳的父母仍对此持怀疑态度，并反复劝阻亲戚，说他买的保健品包装缺乏必要信息，很有可能是“三无产品”，但是这位亲戚却对此深信不疑。\u003c/p\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e“越是劝阻，亲戚反而越相信直播里所谓的老师。他已经买了五六盒所谓的心脑活素，每盒售价1990元，说觉得吃了这个保健品有点效果，甚至还想把降压药停了，以后只吃这个。”罗芳查询发现，该产品未向国家药品监督管理局备案。\u003c/p\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e尽管周围人不断劝说，该亲戚仍执迷不悟，“我提过，让这位亲戚和儿子商量商量，但他坚决不这样做”。罗芳无可奈何，她透露，这个亲戚已经加了三十多个此类社交群，目前已经观看了一个月私域直播，不知购买了多少东西。\u003c/p\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e罗芳曾想向相关部门举报，但她发现，父母二次转发给她的网课链接竟然无法打开。她手中的证据只有一些图片，从反诈人员的角度来说，也很难顺藤摸瓜将其“一锅端”。\u003c/p\u003e\n\u003cp style=\"margin-bottom: 20px; margin-top: 5px; text-align: justify\"\u003e北京市民周叶迷上私域直播后就不再去超市了，而是天天在直播间购物，像上瘾一样。“东西是老年人自愿买的，也不能说都是假冒伪劣产品，就是不值那么高价。”周叶的女儿说，直播间主播善于聊天，还经常唱歌表演，听到他们说东西又好又便宜，父母很容易冲动下单，“我不让买了，我妈还说‘那些孩子都不容易’，让我体谅那些人”。\u003c!--MID_AD_4--\u003e\u003c!--EOP_4--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_4--\u003e\n\u003cp style=\"margin-bottom: 20px;
